Striving To Obtain An Early Release From A Felony Conviction

If you are already facing a criminal sentence, Ohio allows for early release in certain circumstances. For felons, it is sometimes possible for courts to grant a Motion for Judicial Release should certain conditions be met.

But while this provides an avenue for release before serving your entire sentence, meeting these criteria requires having an attorney present your case in court who fully understands the law and your circumstances. Some attorneys do not have the knowledge or experience to obtain an early release through such efforts. Also, it is crucial to understand that you will only have one opportunity to file such a motion. Therefore, please choose wisely when retaining counsel to assist you.

Mitigating The Consequences Of A Misdemeanor Charge

It is a mistake to assume that the consequences of a misdemeanor conviction are minor. Misdemeanor charges do sometimes result in significant fines and jail time. And in Ohio, misdemeanor charges become a part of the public record. The expungement process (erasing or removing charges from your criminal record) is often complex.

Fortunately, the courts sometimes allow filing a Motion to Mitigate misdemeanor charges. Under the right circumstances, the courts will institute another penalty to replace the jail time requirement. However, handling such motions requires considerable care. The attorney arguing the motion must understand the circumstances of your case in detail and argue why mitigation is justifiable.

Mayor’s Court Cases Still Require A Determined Defense

Even though the consequences of misdemeanor convictions in Ohio Mayor’s Courts are not as steep as felonies, this does not mean you do not need an attorney when you are a defendant in Mayor’s Court. Many individuals do not hire an attorney when they are charged with a misdemeanor in Mayor’s Court because they think the charge is not a big deal, or because they feel too embarrassed to talk to somebody and they want to get their case over with as soon as possible.
Even convictions in Mayor’s Courts can have a significant effect on a person’s employment, obtaining or holding certain professional licenses, or obtaining housing. The potential consequences of a misdemeanor conviction in Mayor’s Court cannot be underestimated.
